Hereinafter: the “provider” or “Kimstones”.

These General Terms and Conditions govern the operation of the Kimstones online store, the rights and obligations of users, and the business relationship between the provider and the customer.

2. Offer of products and services

Through its online store, Kimstones offers products including jewellery, crystal products, orgonites and other products, as well as various services.

The main characteristics of a product or service, its price and other information relevant to the purchasing decision are stated alongside the individual product or service.

Product photographs are intended to represent the products as accurately as possible. As part of the offer consists of natural materials and handmade products, minor variations in colour, structure, shape and other natural characteristics of individual products are possible. Such variations do not in themselves constitute a lack of conformity of the product, provided that they are consistent with the nature and description of the product.

3. Product availability

Information on product availability or stock is displayed alongside each product where technically possible.

For products made to order or customised for the customer, the expected production time may be stated instead of the usual dispatch period.

In exceptional cases, a product may no longer be available after an order has been placed, for example due to simultaneous orders or an error in stock records. In such a case, the provider will inform the customer without undue delay and offer another suitable product or refund any payment already made if the customer does not wish to receive a substitute product.

4. Prices

All prices are stated in EUR. The final price payable by the customer is clearly displayed before the order is submitted and includes taxes where applicable.

Delivery costs are not included in the product price unless expressly stated otherwise. The amount of the delivery costs is shown to the customer before the order is submitted.

The price stated at the time the order is placed applies.

When a price reduction is announced, the previous price is determined in accordance with applicable legislation; as a rule, this is the lowest price at which the goods were offered during the 30 days preceding the reduction.

5. Ordering procedure and conclusion of the contract

The customer selects the desired products or services and adds them to the shopping cart. Before submitting the order, the customer has the opportunity to review the order, change quantities, remove products and correct entered information.

Before the order is submitted, the customer is shown at least the selected products or services, their price, any delivery costs and the total amount of the order.

After placing the order, the customer receives confirmation of receipt or confirmation of the order at the e-mail address provided.

The purchase contract is concluded when the provider confirms the order. The order details and the applicable terms and conditions are provided to the customer on a durable medium, i.e. by e-mail.

6. Payment methods

The payment methods currently available are shown to the customer during checkout.

Depending on technical availability, the provider may enable payment by debit or credit card, PayPal, bank transfer or pro forma invoice, as well as other payment methods.

Before confirming the order, the customer can see the final amount and the selected payment method.

7. Delivery

Products are delivered to the areas available to the customer during checkout.

The delivery cost depends on the country of delivery, the size or weight of the shipment and the selected delivery method, and is shown before the order is confirmed.

The estimated delivery or production time is stated alongside the product or communicated to the customer in the order confirmation.

If the delivery deadline cannot be met due to unforeseen circumstances, the provider will inform the customer and provide a new estimated delivery date.

If the shipment is visibly damaged upon delivery, we recommend that the customer document the damage and notify the provider as soon as possible. This recommendation does not limit the customer’s statutory rights in the event of non-conformity of the goods.

8. Right of withdrawal and returns

For a distance contract, the consumer has the right to notify the provider within 14 days that they are withdrawing from the contract, without having to give a reason.

In the case of the purchase of goods, the 14-day period generally begins on the day when the consumer or a third party designated by the consumer receives the goods.

The customer may notify the provider of the withdrawal by e-mail at info@kimstones.com by means of an unequivocal statement of withdrawal.

After notifying the provider of the withdrawal, the consumer must return the goods without undue delay and no later than within 14 days.

The direct cost of returning the goods is borne by the consumer unless the provider expressly states otherwise.

The provider shall refund all payments received from the customer no later than 14 days after receiving notice of withdrawal, including the cost of the least expensive standard delivery method offered by the provider. If the customer chose a more expensive delivery method, the provider is not required to refund the additional cost of that more expensive delivery method.

The provider may withhold the refund until the returned goods have been received or until proof has been provided that the goods have been sent back.

The consumer is only liable for any diminished value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

9. Custom-made and personalised products

The 14-day right of withdrawal does not apply to goods that are made according to the consumer’s precise instructions and adapted to their personal needs.

This may include products made by Kimstones specifically for an individual customer on the basis of their personal requirements, selected measurements, provided data or other individual specifications.

10. Services

When ordering services, the consumer is generally entitled to a 14-day right of withdrawal.

If the consumer wishes the performance of a paid service to begin before the expiry of the 14-day withdrawal period, they must expressly request this.

If the service is fully performed before the expiry of the withdrawal period, the consumer loses the right of withdrawal only if performance began with their explicit prior consent and the consumer confirmed that they understood that they would lose the right of withdrawal once the service had been fully performed.

11. Non-conformity of goods

The provider is liable for non-conformity of goods in accordance with ZVPot-1.

The seller is liable for non-conformity that existed at the time of delivery of the goods and becomes apparent within two years of delivery. If the non-conformity becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery unless otherwise provided by law.

In the event of non-conformity, the consumer may first request that conformity be restored free of charge and may generally choose between repair and replacement, unless the chosen remedy is impossible or would impose disproportionate costs.

Conformity must be restored within a reasonable period, generally no later than 30 days from notification of the non-conformity; under the conditions provided by law, this period may be extended by no more than 15 days.

If conformity is not restored or if other statutory conditions are met, the consumer may request a proportionate reduction in the purchase price or withdraw from the contract.

If the non-conformity becomes apparent within less than 30 days from delivery of the goods, the consumer may, subject to the conditions set out in ZVPot-1, withdraw from the sales contract and request a refund of the amount paid.

The customer may send a complaint to info@kimstones.com, describing the non-conformity and, where possible, attaching photographs or other information that enables the claim to be processed.

The provider strives to deal with complaints as quickly as possible and to resolve any dispute amicably.

13. Protection of personal data

Users’ personal data is processed in accordance with applicable personal data protection legislation.

14. Nature of products and services

The content of the website and the products and services related to astrology, crystals, energy practices, hypnosis and related fields are intended for personal or spiritual growth and well-being.

They do not constitute a medical diagnosis, medical treatment or a substitute for consultation or treatment by a doctor or another appropriately qualified healthcare professional.

15. Protection of personal data, cookies and amendments to the terms

The use of cookies is described in greater detail on the “Cookies” page, while the processing of personal data is described in the “Privacy Policy”.

The provider may amend these General Terms and Conditions from time to time due to changes in legislation, business practices or the functionality of the online store. The terms and conditions in force at the time an individual order is placed shall apply to that order.

The contractual relationship is governed by the law of the Republic of Slovenia, without limiting any rights granted to the consumer under mandatory legal provisions.
